Judgment

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) to enlarge the petitioners on bail in the event of their arrest in connection with Crime No.393 of 2022 of Ongole I Town Police Station, Prakasam District, registered for the offences punishable under Sections 406, 420, 423, 468, 471 r/w 34 of the Indian Penal Code, 1860 (for short “I.P.C.”) and under Sections 4 and 5 of the Andhra Pradesh Land Grabbing Act r/w Section 156(3) of Cr.P.C.
Having heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor and since the offences alleged are all punishable with imprisonment of less than seven years, this Court deems it appropriate to dispose of this criminal petition with a direction to the police authorities to scrupulously follow the procedure prescribed under Section 41A Cr.P.C. and also the guidelines laid down by the Hon’ble Supreme Court in Arnesh Kumar v. State of Bihar (2014) 8 SCC 273.
With the above direction, this Criminal Petition is disposed of.
