Judgment

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 [for short, ‘Cr.P.C’], is filed by the petitioners/A-1 and A-2 seeking to grant pre-arrest bail in Crime No.129 of 2022 of Gollapalem Police Station, Kakinada District, registered for the offences punishable under Sections 341, 353, 506 r/w 34 IPC.
When the matter is taken up for consideration, learned Special Assistant Public Prosecutor contended that the punishment prescribed for the offences registered against the petitioners is upto seven years and as such pre-arrest bail cannot be considered.
Learned counsel for the petitioners also restricted his prayer and confined his request only to the procedure to be followed under Section 41-A Cr.P.C.
In view of the aforesaid, without going into the merits of the case, the Criminal Petition is disposed of directing the concerned police to follow the procedure contemplated under Section 41-A Cr.P.C and the guidelines prescribed by the Hon’ble Apex Court in Arnesh Kumar v. State of Bihar and another [(2014) 8 SCC 273].
