It is seen that nobody appeared on behalf of the Applicant in this IA 320 of 2020 either on 12.09.2023. On the last date of hearing proxy counsel, Mr. Shaan Munshaw appeared for counsel, Ms. Pithu Parimal for the Applicant and sought adjournment in the matter. Today, again proxy Counsel appeared for the Applicant and sought adjournment in the matter.
Learned counsel appearing for the respondent submitted that the applicant has not complied with the order dated 08.05.2023 till date as no steps has been taken in this regard. It is seen that applicant is not interested in pursuing this matter as either simply disappearing in the matter or seeking adjournment through proxy counsel.
Since the order dated 08.05.2023 has not been complied with till date due to the non-seriousness of the counsel for the applicant, we are constrained to dismiss this application for dis-obedience/non-compliance of the order.
