Judgment
K. Sreenivasa Reddy, J
1) The Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed on behalf of the petitioners/A.1, A3 and A4 to grant anticipatory bail in connection with Crime No.249 of 2022 of Station House Officer, Nellore Rural Police Station, SPSR Nellore District.
2) A case has been registered against the petitioner along with others for the offences punishable under Sections 143, 147, 148, 307 and 324 R/w 34 of I.P.C.
3) The accusation that has been alleged against the petitioners is that on 02.08.2022 at 7-00 a.m. at Harijanawada, Kodurupadu Village, Nellore Rural Mandal, all the accused formed themselves into an unlawful assembly and attacked the complainant and his associates with deadly weapons and attempted to murder them and caused injuries to them due to previous disputes between both groups regarding birthday flexi. All the injured were admitted in GGH, Nellore wherein the police recorded the statement of the defacto-complainant. Basing on the same, a case in Crime No.249 of 2022 was registered.
4) Heard. Perused the record.
5) It is admitted by the learned Public Prosecutor that a counter-case has been registered against the complainant herein and others in Crime No.248 of 2022 basing on the statement of the petitioner/A.1.
6) In view of the facts and circumstances of the case, this Court feels that the petitioners are entitled for anticipatory bail.
7) Accordingly, in the event of their arrest in the above crime, the petitioners are directed to be released on bail on each of them executing personal bonds for a sum of Rs.10,000/- (Rupees ten thousand only) each, with two sureties each for the like sum to the satisfaction of the arresting police officials and also on condition that the petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses.
8) Accordingly, the criminal petition is allowed.
Consequently, miscellaneous applications pending, if any, shall stand closed.
