This petition is filed under Sections 437 and 439 of Code of the Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking regular bail to the petitioner/ A-4 in connection with Crime No.206 of 2021 of Martur Police Station, Prakasham District, registered for the offence punishable under Section 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity "NDPS Act").
The case of prosecution is that on 11.06.2021 on receipt of credible information about illegal transportation of ganja, the respondent police along with staff and mediators rushed to Rajupalem Rest area on the Eastern side of NH-16, Martur Village and Mandal, and found the petitioner along with other accused while they were shifting ganja into the vehicles. They arrested the accused and seized 180 KGs of ganja in 90 packets and two vehicles bearing Nos.TN 11/3435 and AP 39 AB 6999 and cell phones under the cover of a mediators report. Basing on the said report, present crime was registered.
Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State.
Learned counsel for petitioner submits that the petitioner is languishing in jail from 11.06.2021. The petitioner is neither involved nor in any way connected with the alleged offence. He further submits that in this case investigation is completed and charge sheet is also filed. Hence, his case may be considered for grant of bail.
Learned Assistant Public Prosecutor submits that the contraband involved in this case is 180 KGs which is a commercial quantity. Hence, petitioner is not entitled for bail.
Taking into consideration the fact that the contraband that is seized from the possession of the petitioner is 180 KGs which is a commercial quantity, this Court is not inclined to grant bail to the petitioner.
In view of the above, the Criminal Petition is dismissed.
Consequently, miscellaneous applications pending, if any, shall stand closed.
