Learned counsel for the appellant at the very outset submitted, in all fairness, that this appeal has been rendered infructuous as the principally impugned Order has already been executed and thus he does not wish to pursue the appeal any further with regard to the same.

However, he additionally submits that there is some application dated 31.10.2016 moved on behalf of the appellant, before the State Commission, but no orders in that regard have been passed so far and the application is lying undisposed. It is being prayed during the course of arguments that a direction may be made to the State Commission to pass appropriate orders on the said application as per law.

In the wake of the submissions as has been made by the learned counsel for the appellant, appeal no. 511 of 2021 does not survive having been rendered infructuous.

So far as the said application dated 31.10.2016 is concerned the State Commission is requested to look into the same and if no appropriate orders in that regard have been passed so far, the State Commission may do the needful in accordance with law.

The Registry is requested to send a copy each of this Order to all parties in the appeal as well as to the State Commission within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
