Taken up in physical hearing.
Heard the learned counsel for the appellant builder co. at admission. Perused the material on record, including inter alia the Order dated 14.05.2020 of the State Commission and the memorandum of appeal.
This appeal has been filed against the Order dated 14.05.2020 of the State Commission whereby interim relief has been provided to the respondents complainants.
Learned counsel for the appellant builder co. submits, on instructions, that the builder co. wishes to withdraw its appeal with liberty to raise its issues and contentions and make its submissions before the State Commission itself.
The appeal no. 569 of 2021 is dismissed as withdrawn with liberty to the appellant builder co. to raise its issues and contentions and make its submissions, as it may be advised, before the State Commission. Needless to add, the State Commission shall address the same on merit as per the law.
The Registry is requested to send a copy each of this Order to all parties in the appeal within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
