Even though learned counsel for the respondents, Ms. Barkha Babbar, raised certain objections with regard to territorial jurisdiction, but after making

submissions for some time, Shri Manoj Kr. Gupta, learned counsel for the applicant, pointed out that he has certain judgments based on which similar

issues have been allowed by this Tribunal and, therefore, he wants to withdraw the application for the present with the liberty to point out all these

facts to the Competent Authority by way of a representation and thereafter in case his representation is not considered, to again re -agitate the matter

in accordance with law.

Finding the aforesaid prayer to be reasonable, the application is permitted to be withdrawn. Liberty is granted to the applicant to represent to the

Competent Authority and thereafter take recourse to such remedy as may be permissible in law after the representation is decided, if any grievance

subsists.

OA stands disposed of as withdrawn with the aforesaid liberty.
