Heard learned counsel for the applicants, who states that the matter is squarely covered by the judgment of the Hon'ble High Court of Madras in its W.P.C. No.19215 of 2015 and M.P. No. 1 of 2015 & WMP No.1197/2016 in the case of N. Subramanian vs. The Commissioner & others., passed on 24.02.2017. He further states that the applicant will be satisfied if the respondents are directed to decide his legal notice dated 01.07.2018, keeping in mind the rationale discussed in the aforesaid judgment and also the orders passed by the Tribunal in OA Nos.3112/2013 & OA 2863/2018.

In view of the limited prayer of the applicants counsel, the OA is disposed of with a direction to the respondents to decide his legal notice date 01.07.2018, keeping in mind the orders passed by the Tribunal in OA Nos. 3112/2013 on 19.09.2016(Hoshiar Singh vs. UOI & ors), OA No.2863/2018 on 31.07.2018(Mrs. Veena Rani & Ors. vs. UOI & Ors) and the judgment dated 24.02.2017 passed by the Hon'ble High Court of Madras in the case of N. Subramanian vs. The Commissioner & others. (supra) within a period of 90 days from the date of receipt of a certified copy of this order.

It is made clear that noting has been commented on the merits of the case.
