O R D E R

Referring to Annexure A-5 of OA, the learned counsel for the applicant has made a statement at the Bar that similar controversy has already been put to rest by this Tribunal in O.A No. 869/2025 – Mragendra Sharma & Ors. Vs. U.O.I & Ors vide order dated 29.01.2026. Learned counsel has also stated that as the subject matter of this O.A and O.A No. 869/2025 are one and the same and the relief/s sought by the applicants are similar, merely having different dates would not in any way disturb the ultimate direction to be given by this Tribunal in the light of observation made in order dated 29.01.2026.

The original application no. 869/2025 was allowed based upon the order of the Hyderabad Bench of this Tribunal passed in OA No. 1089/2019 which has been affirmed upto the Hon’ble Supreme Court and judgment of Hon’ble High Court of Madhya Pradesh dated 18.03.2025 passed in Misc. Petition No. 177/2025. The observation of the Tribunal in para 6 of the order dated 29.01.2026 is reproduced below: -

“6.

We have considered the matter and we have no hesitation to held that the issue involved in this Original Application is no longer res-integra as the same has already been decided by the coordinate Bench at Hyderabad in OA No. 1089/2019 (Supra) and the order passed by the Hyderabad Bench has also been affirmed up to the Hon’ble Supreme Court. Similarly, this Tribunal has also disposed of OA No. 404/2024 in line with the order passed by the Hyderabad Bench of this Tribunal and the order passed by this Tribunal in the aforesaid case has also been affirmed by the Hon’ble High Court of Madhya Pradesh in Misc. Petition No. 177 of 2025 decided on 18.03.2025. Keeping in view the aforesaid fact, we dispose of these Original Applications in terms of the order passed by the Hyderabad Bench in OA No. 1089/2019 (Supra). No order as to costs.”

In view of the statement of the learned counsel for the applicant which has not been controverted by the learned counsel for the respondents, the present Original Application is allowed in the light of order dated 29.01.2026 passed by this Tribunal in O.A No. 869/2025. The applicant is directed to submit a certified copy of this order alongwith copy of the order dated 29.01.2026 before the respondents who shall consider the claim of the applicant in the light of observations made therein within a period of 90 days from the date of receipt of certified copy of this order.
