Petitioner has filed this petition under Article 226 of Constitution of India making following prayer :

I. Issue a writ in the nature of mandamus directing the respondent-department to comply with the provision of section 10 and 12 of Payment of Bonus Act, 1965 by making payment of yearly bonus to their employee from year 2008-09 to 2015-16, in the interest of justice;

II. Issue a writ in the nature of mandamus directing the respondent department to consider the grievance of petitioner for payment of bonus in the light of letter dated29.04.2016 (Annexure P/4), in the interest of justice;

III. Issue a writ in the nature of mandamus directing the respondent No. 2 to consider and decide the pending representation dated 13.10.2016 (Annexure P/3) in respect of payment of yearly bonus under the provision of section 10 and 12 of the Act, 1965 within stipulated period, in the interest of justice;

IV. Issue any other writ, order or direction as this Hon’ble Court deem fit.

It is submitted by counsel for petitioner that representation of petitioner is pending and has not been considered and decided.

Govt. Advocate appearing for State submitted that representation of the petitioner shall be considered by the competent authority in accordance with law.

Heard learned counsel for parties.

Considering aforesaid submissions, petition is disposed of directing petitioner to file fresh representation supported by documents and order passed by this Court before respondent no.2-competent authority. On same being done, respondent no.2-competent authority shall consider and decide the same by a reasonable and speaking order within a period of 90 days from the date of receipt of certified copy of order passed today along with copy of representation and thereafter decision be communicated to the petitioner.

It is made clear that this Court has not expressed any opinion on merits of the case.

With aforesaid, writ petition is disposed of.
