By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of

mandamus, directing the respondents to release the arrears/dues as per judgment passed by Hon'ble Supreme Court in Contempt Petition No.408 of

2011 in W.P(C) 427/1999 along with interest @ 18% p.a. And further to decide the representations (Annexures P-4 & P-6).

At the very outset of the arguments, learned counsel for the petitioner submits that petitioner approached the respondents number of times by way

of representations (Annexures P-4 and P-6) followed by legal notice dated 17.01.2018 (Annexure P-7) but till date neither any response has been

received nor any conscious decision has been taken. He further submits that petitioner feels satisfied in case direction is issued to respondent No.1 to

decide the representations/legal notice, within a stipulated period.

Without expressing any opinion on merits of the case, instant petition is disposed of with a direction to respondent No.1-Chairman & Managing

Director, British India Corporation Ltd., Head Office, 11/6, Smt. Parvati Bagla Road, Post Box-77, Kanpur (U.P.) to look into the grievances

unfolded by the petitioner in representations as well as in legal notice and to decide the same in the light of judgment passed by Hon'ble Apex Court

in contempt petition No.408 of 2011 in W.P.(C) 427/1999, within a period of four months from the date of receipt of certified copy of this order.

However, if the petitioner still feels aggrieved against the order passed by the concerned authority, he shall be at liberty to have recourse to the

other remedies as well as to approach this Court.
