Judgment
After some argument, Mr. Anupam Lal Das, Ld. Sr. Counsel assisted by Mr. Nilesh Sharma, Ld. Counsel for the Appellant in the presence of Mr. Iswar Mohapatra, Ld. Counsel for Respondent No.1 requests for permitting him to withdraw this appeal with liberty to approach the Tribunal. In terms of order dated 04.05.2023, he submits that in advertently instead of pursuing the matter before the NCLT he directly approach this Appellate Tribunal. He requests that liberty may be granted to the Appellant to request the NCLT to examine the application for interim relief expeditiously. The prayer for withdrawal of appeal is allowed with liberty as indicated herein above.
It goes without saying that if such application is filed the Ld. NCLT without being prejudiced with this order may examine the same and pass appropriate order in accordance with law expeditiously.
It is clarified that we have not recorded any opinion on the merit of the case.
With above observation, the appeal stands dismissed as withdrawn.
