Mr. Krishnendu Datta, learned senior counsel assisted by Mr. Nakul Mohta, learned counsel for the appellant in presence of Mr. Shyam S Dewani, learned counsel, who has appeared on advance notice on behalf of Respondent No.1, 3 and 4 requests that he may be permitted to withdraw this appeal with liberty to raise all the points which have been raised in this appeal before the Learned NCLT. Only request is being made that Learned NCLT may be requested to consider the plea of the appellant herein expeditiously preferably within a period of four weeks from the date of filing of the application.

Since reasonable prayer is being made, there is no reason to refuse the same. The appellant herein is granted liberty to file appropriate application and if such application is filed within two weeks from today the learned NCLT may grant liberty to the other side to file their response but it may be filed within two weeks thereafter. We expect that the learned NCLT may consider the application of the appellant and after hearing the parties may pass the order but within four weeks from the date of completion of pleading.

With the above observations, the appeal stands dismissed as withdrawn.
