Judgment
When the matter is taken up Mr. Iswar Mohapatra, Advocate appearing on behalf of the Appellant submits that he has filed an Affidavit on 25.07.2023 bringing on record the copy of ‘Settlement Agreement’ arrived between the parties which is at page 3 to 7 of the Affidavit.
Learned Counsel for the Appellant further submits that he may be permitted to withdraw the instant Appeal in terms of settlement arrived between the parties.
In view of the submissions made by the Learned Counsel for the Appellant this Appeal is dismissed as withdrawn. Let the aforesaid ‘Settlement Agreement’ be part of the order. However, so far as fees of the IRP is concerned, the IRP may approach the NCLT for the fees and expenses incurred by IRP.
In the meanwhile, interim order dated 18.07.2023 shall continue till final order is passed by the NCLT. We request the Adjudicating Authority (National Company Law Tribunal, Chandigarh Bench, Chandigarh) to list the matter on 25th September, 2023.
