This Criminal Petition has been filed seeking to quash the proceedings in D.V.C.No.16 of 2024, on the file of learned V Metropolitan Magistrate-cum-I Additional Junior Civil Judge, Medchal-Malkajgiri District at L.B.Nagar against the petitioners/respondent Nos.1 to 7.

Heard Mr.Thota Venkatesham, learned counsel for the petitioners and Mr.Jithendar Rao Veeramalla, learned Additional Public Prosecutor for respondent No.4.

Though the criminal petition was filed seeking to quash the proceedings in D.V.C.No.16 of 2024, the learned counsel for the petitioners restricted his prayer requesting this Court to dispense with the appearance of the petitioners/respondent Nos.1 to 7 in D.V.C.No.16 of 2024, on the file of learned V Metropolitan Magistrate-cum-I Additional Junior Civil Judge, Medchal-Malkajgiri District at L.B.Nagar.

The learned Additional Public Prosecutor has not opposed the submission made by the learned counsel for petitioners.

Taking into consideration the peculiar facts and circumstances of the case, the presence of petitioner Nos.2 to 7 respondent Nos.2 to 7 before the learned V Metropolitan Magistrate-cum-I Additional Junior Civil Judge, Medchal-Malkajgiri District at L.B.Nagar, in D.V.C.No.16 of 2024 is dispensed with, unless their presence is specifically required during the course of the trial, subject to the condition that the petitioner Nos.2 to 7 respondent Nos.2 to 7 shall be represented by their counsel on every date of hearing. In the event of non-appearance of petitioner Nos.2 to 7 respondent Nos.2 to 7 on any date so fixed by the trial Court, the trial Court shall be entitled to proceed with the matter in accordance with law. However, no such relief is granted against petitioner No.1 respondent No.1.

Accordingly, the criminal petition is disposed of. Pending miscellaneous applications, if any, shall stand closed.
