Judgment
Kongara Vijaya Lakshmi, J
This Contempt Case is filed alleging violation of the orders, dated 24.04.2019, passed in W.P.No.5677 of 2019.
The said writ petition was filed to declare the action of the respondents 2, 3 and 6, in not paying compensation for acquiring the lands of the petitioners admeasuring an extent of Ac.5.00 cents, situated in Sy No 402/2, its subdivisions A, B, C, D, E, F, G, H, 1, J and K of Krishnunipalem Village, Gokavaram Mandal, East Godavari District, under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013 as illegal and arbitrary.
The said writ petition was disposed of by observing as follows;
"Without going into the merits of the case with regard to entitlement of the petitioners and as the 2nd respondent-District Collector, East Godavari District, has already addressed a letter to the 5th respondent-Sub-Collector, R & R Officer, Ramachandrapuram, East Godavari District, asking him to go through the contents of the representation/legal notices got issued by the petitioners, on 11.1.2019 and 18.3.2019 and also to take necessary action, the 5th respondent is directed to comply with the said direction issued by the 2nd respondent on 29.1.2019 and take appropriate action in accordance with law, as expeditiously as possible".
Counter affidavit is filed by the respondent-Revenue Divisional Officer by enclosing a copy of the letter addressed by the Revenue Divisional officer to the District Collector on 10.12.2020, the operative portion of the said letter reads as follows;
"In view of the above grievance, I request the District collector, East Godavari, Kakinada to instruct the Special Collector (LA) Polavaram Irrigation Project, Rajamahendravaram and the Special Deputy Collector, (LA) Polavaram irrigation Project, Rajahmahendravaram to take necessary action on the petition filed by Sri Bedampudi Krishna on 11.1.2019 and 18.3.2019 and to comply the order of the Hon'ble High Court of Andhra Pradesh in W.P.No.5677/2019 dated 24.4.2019 in accordance of law as he was approved resumption order to resume the land measuring Ac.5.52 cents covered in Sy.No.402/2 of Krishnunipalem village of Gokavaram Mandal vide reference 5th cited."
In view of the said letter, learned counsel for the petitioner submits that the order passed in the writ petition has been complied with.
In view of categorical statement made by the learned counsel for the petitioner, no orders are required to be passed in the present Contempt Case. Accordingly, the present Contempt Case is closed. There shall be no order as to costs.
As a sequel, miscellaneous petitions, if any, pending in this case shall stand closed.
