Judgment
Questioning the action of the respondent Nos.4 to 11 in not considering the representations of the petitioner dated 13.02.2023, 22.02.2023, 16.02.2024, 19.02.2024, 10.06.2024 and final representation dated 26.05.2026 in not taking any action concerning the obstruction and diversion of the natural stream at Nermata Village, Chandur Mandal, Nalgonda District, the flooding of the village clay road and nearby houses and the danger caused to the villagers, the petitioner has filed the present writ petition with a consequential prayer to direct the respondents to conduct a joint inspection and survey, demarcate the natural stream and the village road, as per the revenue records and to consider the said representations of the petitioner and take necessary action in accordance with law to remove the identified encroachments and obstructions, to restore the natural flow of the stream, to deal with unused water tank situated in the stream course, to repair the village road and prevent further unauthorized construction in the affected areas.
Heard Mr. Nikhil Reddy Parapati, learned counsel for the petitioner, learned Government Pleader for Revenue appearing for respondent Nos.1, 4 to 6, learned Government Pleader for Panchayat Raj appearing for respondent Nos.2 & 8, learned Government Pleader for Irrigation appearing for respondent Nos.3, 10 & 11 and Sri K. Pradeep Reddy, learned Standing Counsel for Zilla Parishad appearing for respondent Nos.7 & 9. With the consent of both the parties, the writ petition is being taken up for disposal. Perused the entire record.
Though various grounds are raised in the writ affidavit, learned counsel for the petitioner confines his submission to the extent of early disposal of the representations of the petitioner dated 13.02.2023, 22.02.2023, 16.02.2024, 19.02.2024, 10.06.2024 and final representation dated 26.05.2026 and praying this Court to give a direction to the respondent Nos.4 to 11 to conduct a joint inspection and survey, demarcate the natural stream and the village road as per revenue records.
Learned Government Pleaders and learned Standing Counsel would submit that the representations dated 13.02.2023, 22.02.2023, 16.02.2024, 19.02.2024, 10.06.2024 and final representation dated 26.05.2026, stated to have been made by the petitioner, would be considered, if not already considered, and appropriate orders will be passed in accordance with law and prayed this Court to pass appropriate orders.
In that view of the matter, recording the aforesaid submissions and with the consent of the learned counsel on either side, without going into the merits of the case, this Court deems it fit and proper to direct the respondent Nos.4 to 11 to consider the representations dated 13.02.2023, 22.02.2023, 16.02.2024, 19.02.2024, 10.06.2024 and final representation dated 26.05.2026, stated to have been made by the petitioner, if not already considered, and to take necessary action with respect to the natural stream situated at Nermata Village, Chandur Mandal, Nalgonda District, the flooding of the village clay road and nearby houses and inconvenience caused to the villagers and pass appropriate orders thereon in accordance with law, within a period of Four (04) weeks, from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. There shall be no order as to costs.
As a sequel, miscellaneous applications, if any pending in this writ petition, shall stand closed.
