Hearing through video conferencing

Mr. H R Qureshi, learned counsel for the applicant stated that the applicant is aggrieved of Order No. 253 of 2025 dated 26.09.2025 passed by Respondent No. 2, whereby the applicant has been illegally and arbitrarily placed under suspension and has been ordered to be attached with Govt. ITI Kishtwar without application of mind. As per the learned counsel, the applicant is physically handicapped from lower limb, as is evident from the Medical Board Certificate dated 26.12.2002, besides the place to where he has been transferred is around 600 kms from his home.

Learned counsel further stated that the applicant would be satisfied, at this stage, if a direction is issued to respondents to treat a copy of this O.A. as representation of the applicant and decide the same within a time frame.

Mr. Rajesh Thapa, learned A.A.G. appearing on behalf of the respondents vehemently opposed the prayer made by the learned counsel for the applicant and prayed for sometime to file counter affidavit

Having heard the learned counsels for the parties, we are of the considered view that no useful purpose would be served in keeping the instant O.A. pending and the same can be disposed of in the manner as prayed for by the learned counsel for the applicant.

Accordingly, the O.A. is disposed of, at the admission stage itself, without entering into the merits of the case, with a direction to respondents to treat a copy of this O.A. as representation of the applicant and consider the case of the applicant for attachment at a nearby place keeping in view his physical disability and pass a reasoned and speaking order in this regard. Let this exercise be completed within a period of four weeks from the date of receipt of a certified copy of this order.

Till then, no coercive against be taken against the applicant for making him join at ITI Kisthwar.

With the above direction, the O.A. stands disposed of.

No order as to costs.
