Learned counsel appearing for the applicant prays permission to withdraw the application with liberty to file proper application in accordance with law. In fact, another application was filed earlier which was withdrawn with liberty to file fresh application. Even the present application is not properly filed as the prayer is to revoke the order of CRZ Clearance dated 03.01.2014, contending that there was no public hearing. When the learned counsel was asked how the application is maintainable as it is filed after 3 years, the learned counsel submitted that a similar application i.e. Application No.165 of 2017 is pending before the Tribunal. In the light of these facts there is no valid ground to grant the liberty to file an application afresh as the applicant can get impleaded in the pending application.

The applicant is at liberty to file an application to get himself implead in the pending proceedings i.e. Application No.165 of 2017.

The application is dismissed as withdrawn with liberty to get impleaded in Application No.165 of 2017. No order as to costs.
