We have heard the learned counsel appearing for the applicant after arguing the case for sometime. In as much as it is informed that the learned counsel appearing for the respondent submits that learned Appellate Authority is functioning in Karnataka, liberty may be given to the applicant to appeal against the consent order given by the Pollution Control Board which is the subject matter of issue before this Tribunal.

Accordingly, the applicant is permitted to withdraw the application and the application is dismissed as withdrawn, however, with liberty to the applicant approach the learned Appellate Authority to file appropriate appeal. We also make it clear that in so far as it relates to Environmental Clearance (EC) and any other issue, it is always open to the applicant to approach this Tribunal as and when the cause of action arises.

With the above direction, the application stands closed. Since the main application stands closed, M.A.No.303 of 2016 also stands closed as no order is necessary.
