Judgment
Heard Mr. Vemula Suresh, learned counsel for the petitioner and Mr. Putta Krishna Reddy, learned standing counsel for Municipalities, appearing for respondent No.2.
Learned standing counsel for respondent No.2 placed on record written instructions and submitted that there is no proposal or plan to lay or widen the road in front of petitioner’s property bearing H.No.4-8-213, Alampally Village, Vikarabad District.
Learned counsel for the petitioner submitted that there is interference by respondent No.2 with the possession and enjoyment of the petitioner over the open backyard of the subject property in the guise of laying Cement Concrete (CC) road.
Learned standing counsel for respondent No.2 submitted that no part of land allegedly in possession of the petitioner is being disturbed. If any property of the petitioner whether on the front or rear side is to be taken or required for road widening, appropriate action will be taken in accordance with law.
Recording the submissions of learned standing counsel for respondent No.2, writ petition is disposed of. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
