It is seen from the record that matter was called on 16.08.2023, when none appeared for the OC. When the matter was called today again, none appeared for the OC. Counsel for the CD invited our attention to the memorandum of settlement whereby the parties had settled the matter. He further submits that the entire amount of Rs.40 Lakhs has been transferred to the account of the FC and nothing is due. In view of the above, CP is dismissed as disposed of. File be consigned to record.
