Judgment

Heard Mr. S. Harichandan, learned counsel for the petitioner and Mr. D.K. Mishra, learned Addl. Government Advocate for the State.
This is an application under Section 439 of Cr.P.C. for grant of bail to the petitioner in connection with Sarangada P.S. Case No. 57 of 2023 corresponding to C.T. Case No. 238 of 2023 pending in the Court of the learned S.D.J.M., Balliguda under Sections 457, 395, 397 of IPC and Section 25 of Arms Act.
The prayer of the petitioner has been rejected vide order dated 07.09.2023 by the learned Addl. Sessions Judge, Balliguda.
Considering the nature of allegations against the petitioner and as the investigation is in progress, I am not inclined to entertain the prayer for bail at this stage and dismiss the BLAPL granting liberty to the petitioner to approach the learned Court below for bail afresh after completion of the investigation.
Urgent certified copy of this order be granted on proper application.
