Judgment

This application under Section 439 of the Cr.P.C. has been filed in connection with Bikrampur P.S. case No. 307 of 2023 corresponding to G.R case No. 1489 of 2023 pending in the Court of learned S.D.J.M.,Talcher registered against the petitioner and brother of Sridhar for commission of offences punishable under Section 294,323,506,34 of the IPC, read with Section 25 of the Arms Act. The petitioner has been arrested on 14.11.2023 and forwarded for commission of offences punishable under Section 294,323,307,385,506,34 of the IPC read with Section 25, 25(7), 27 of the Arms Act.
The prayer for bail of the petitioner has been rejected on 29.11.2023 by the learned Assistant Sessions Judge, Talcher, in BLAPL No. 695 of 2023, when investigation was in progress.
Considering the nature of allegations against the petitioner and large number of criminal antecedents, I am not inclined to consider his prayer for bail at this stage.
The BLAPL is accordingly dismissed granting liberty to the petitioner to move for bail afresh after completion of the investigation.
Urgent certified copy of this order be granted on proper application.
