Heard Mr. K.B. Satapathy, learned counsel for the petitioners and Mr. D.K. Mishra, learned Addl. Government Advocate for the State.
This is an application under Section 439 of Cr.P.C. for grant of bail to the petitioners in connection with Sarangada P.S. Case No.57 of 2023 corresponding to C.T. Case No. 238 of 2023 pending in the Court of the learned S.D.J.M., Balliguda under Sections 457, 395, 397 of IPC and Sections 25/27 of Arms Act.
The prayer of the petitioners had been rejected vide order dated 29.08.2023 by the learned Addl. Sessions Judge, Balliguda.
Considering the nature of allegations against the petitioners and as the investigation is in progress, I am not inclined to entertain the prayer for bail at this stage and dismiss the BLAPL granting liberty to the petitioners to approach the learned Court below for bail afresh after completion of the investigation.
Urgent certified copy of this order be granted on proper application.
