Judgment
Arindam Lodh, J
Heard Ms. S. Nag, learned counsel for the petitioner. Also heard Mr. S. Ghosh, learned Additional PP appearing for the respondent-State.
This is an application filed under section 439 Cr.P.C. for granting bail to the accused petitioner who is in custody since 25.06.2022 in connection with Dharmanagar PS case no. 2022 DMN 087 registered under sections 448/307/325/506 of the IPC.
It is alleged that the accused petitioner is owner of a medical shop and he has assaulted his younger brother over long standing property dispute.
I have gone through the case record.
It is found that the accused was arrested on 25.06.2022 and already 18 days have elapsed over.
Considering the dispute between two brothers and the nature of injuries, and to bring and develop better understanding amongst the family members, particularly, the brothers, in my opinion, it would be beneficial to release the accused person on bail. I have also kept in mind that this is not the stage of punishment. Further detention of the accused person may cause the relation more bitter. Let good sense prevail over him.
Considering all these aspects, the accused-petitioner is released on bail on furnishing a bond of Rs. 25,000/- with one surety of the like amount to the satisfaction of the learned Sessions Judge, Dharmanagar, North Tripura.
With this observation and direction, the instant application stands allowed and disposed of.
