Heard Mr. S. Chakraborty, learned counsel appearing for the petitioner as well as Mr. S. Debnath, learned Addl. P.P. appearing for the State respondents.

This is an application filed under Section 439 of Cr.P.C praying for granting bail in favour of the accused person, namely, Sri Raghunath Lodh, who is in custody for about 16 days in connection with West Agartala P.S. Case No.156 of 2021, registered under Sections 447/427/435/436/34 of the Indian Penal Code.

The facts, in brief, are that on 8th September 2021, a group of persons had attacked the CPI(M) party office and the accused person, namely, Sri Raghunath Lodh allegedly was one of such attackers. The accused-Raghunath Lodh is at present admitted at GBP Hospital and is under treatment after his arrest. The learned counsel appearing for the petitioner has prayed for releasing the petitioner on conditional bail for his better treatment outside Agartala.

Mr. Debnath, learned Addl. P.P. appearing for the State-respondent has not opposed such prayer of the petitioner.

Accordingly, the accused-Sri Raghunath Lodh is released on conditional bail up to 15.11.2021. The accused-Raghunath Lodh shall furnish a bail bond of Rs.50,000/-(Rupees fifty thousand) only with one surety each of the like amount to the satisfaction of the learned Chief Judicial Magistrate, West Tripura, Agartala. However, the accused-Raghunath Lodh is to abide by the following conditions:-

i) He shall surrender to the Court of learned CJM on 16.11.2021;

ii) The accused-person shall not try to tamper the evidence and he shall duly cooperate with the investigating officer in all respects.

A certified copy of the order may be furnished to the learned counsels appearing for the parties within the course of the day on payment of the requisite fees. However, the state is not required to pay the fees.

With the aforesaid order and directions, the instant application stands allowed and disposed.
