Judgment
Arindam Lodh, J
Heard Mr. TD Majumder, learned senior counsel assisted by Mr. T. Halam, learned counsel appearing for the petitioner as well as Mr. Ratan Datta, learned PP assisted by Mr. S. Ghosh, learned Additional PP appearing for the State-respondent.
This is an application filed under section 439 Cr.P.C. for granting bail to the accused in connection with R.K.Pur PS case no. 2021 RKP 151 registered under sections 302/326 of the IPC.
Mr. Majumder, learned senior counsel for the petitioner has submitted that the accused is in custody for more than 142 days. Mr. Majumder has also submitted that there was a quarrel between the accused and his brother (victim) relating to property dispute and during such quarrel the mishap had happened.
I have gone through the case record.
After perusal of the case record, it is found that charge sheet has already been submitted and trial has also been commenced. Further, there is no allegation that the accused has tried to influence any of the witnesses.
Having considered the allegation leveled against the accused, in my opinion the accused may be enlarged on interim bail till 25.10.2022.
Accordingly, the accused, Nur Mohammad Khadim alias Nomad shall be released on bail on furnishing a bail bond of Rs. 1,00,000/- supported by one surety of the like amount to the satisfaction of the learned Sessions Judge, Gomati Judicial District, Udaipur. It is further directed that the accused shall appear before the Investigating Officer as and when required and shall co-operate with the investigation of the case.
List the matter on 25.10.2022 on which date learned PP shall produce the case diary.
Copy of this order be supplied to the learned counsel appearing for the parties.
