Judgment
In terms of the order dated 06.08.2021 it appears that Respondent No. 1 and 2 are directed to file hard copy of Reply Affidavit. Record reveals that the Learned Counsel for the Respondent No. 1 has filed the hard copy of Reply Affidavit which is taken on record. Today, The Respondent No. 2 has not appeared nor filed Reply Affidavit.
Learned Counsel for the Appellant submits that he has filed the service affidavit, which is taken on record. He further submits that copy of the Appeal as well as the order has been served to the Respondent No. 2 through Speed post on 18.08.2021 and the same has been received by the Respondent No. 2 on 19.08.2021 and 20.08.2021 through speed post.
Learned Counsel for the Appellant seeks and is granted further two weeks' time to file hard copy of the Rejoinder to Reply Affidavit filed by the Respondent No. 1.
List the Appeal 'For Admission (After Notice)' on 29th November, 2021.
On that day, if Respondent No. 2 will not appear, this Appellate Tribunal may proceed to pass ex-parte.
