This petition is filed under Sections 437 and 439 of Code of the Criminal Procedure, 1973 (for short Cr.P.C.‟) seeking bail to the petitioners/Accused Nos.1 to 3 in connection with Crime No.163 of 2021 of Rural Police Station, Vizianagaram, Vizianagaram District, wherein the petitioners are alleged to have committed the offence punishable under Section 8 (c) r/w 20(b) (ii) (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity "NDPS Act").
Heard learned counsel for the petitioners/ Accused Nos.1 to 3 and learned Special Public Prosecutor appearing for the respondent-DRI.
Without going into the merits of the case, as the quantity involved in this crime is commercial quantity and further as the investigation is pending, this Court is not inclined to grant bail to the Accused Nos.1 to 3.
Accordingly, the Criminal Petition is dismissed. However, liberty is given to the Accused Nos.1 to 3 to renew the bail application after completion of statutory period.
Consequently, miscellaneous applications pending, if any, shall stand closed.
