Petitioners were appointed as Assistant Professors in the 5th respondent college in the year 2013. Petitioners claim to be entitled to be included in the statutory pension scheme under KSR Part III since their selection process culminated before 01/04/2013. Seeking such inclusion, petitioners have submitted Exts.P8 to P10 representations before the 1st respondent which are pending consideration. Petitioners seek for an expeditious consideration of the same.
The learned Government Pleader submits that the issue is already covered by the judgments of this Court in W.P. (C).No.3577/2021 and O.A.(EKM).No.1326/2022 and has been answered against the petitioners.
Be that as it may, it would be open for both the parties to place their contentions before the 1st respondent while representations are being considered.
Accordingly, without expressing anything on merits, the writ petition is disposed of directing the 1st respondent to consider and pass appropriate orders on Exts.P8 to P10 representations, with due notice to all concerned, after affording an opportunity of hearing. Let orders be passed within a period of three months from the date of receipt of a copy of this judgment.
