The petitioners, who are Teachers and non teaching staff of the Janta Junior High School, Jyundana, Block Bhilangana, District Tehri Garhwal were prior appointed to the cut off date i.e. 01.10.2005. The petitioners, by means of present petition want to be included under the Old Pension Scheme on the basis of their date of initial appointment in the institution. The institution was brought under grant in aid vide order dated 10.02.2014. The petitioners moved a representation to the respondent no.5-Committee of Management of the institution for bringing them within the Old Pension Scheme in view of their initial appointment, which relates back prior to the cut off date i.e. 01.10.2005. The said representation (Annexure 20) was forwarded by the Committee of Management to the respondent no.4-District Education Officer (Elementary Education) District Tehri Garhwal, New Tehri.

The petitioners contend that the said representation of the petitioner is still pending disposal and no decision has been taken thereon. It is contended that if a direction is issued to the respondent no.4 to take a decision on the representation of the petitioner in accordance with law, ends of justice would be met.
The learned counsel for the State has no objection if such a prayer is allowed.
The writ petition is finally disposed of. The respondent no. 4 is directed to take a decision on the representation of the petitioner dated 16.04.2021 which was forwarded to him on 21.04.2021 by the Committee of Management, within a period of two months from the date of production of certified copy of this order, keeping in view the fact that petitioners have been appointed prior to the cut off date i.e. 01.10.2005.
