This Criminal Petition is filed seeking bail under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (‘CrPC’) to the petitioner/A.3 in Crime No.10 of 2023 of SHO Special Enforcement Bureau, Gopalapatnam, Visakhapatnam City registered for the offence punishable under Section 22 (b) R/w 8 (c) of NDPS Act.

Heard learned counsel for the petitioner/A.3 and learned Assistant Public Prosecutor representing the respondent/State.

The case of prosecution is that the petitioner is involved in the offence of selling Pentazocine Lactate Injections. It is further case that the petitioner is not involved in this case alone, but also another case in Crime No.9 of 2023 of Station House Officer, Special Enforcement Bureau, Gopalapatnam Visakhapatnam for the similar offence.

Learned counsel for the petitioner submitted that the false case was foisted.

Learned Assistant Public Prosecutor opposed the petition submitting that huge amount of contraband has been seized and he has criminal antecedents of involving in similar offences and he is a habitual offender and that he has involved in Crime No.179 of 2022 of II Town Police Station, Visakhapatnam registered under Section 328, 284 r/w 34 IPC, Section 22 (c) R/w 8(c) of NDPS Act and Section 18 (C) of D.C.Act. It is further stated that the petitioners is involved in another case Crime No.15 of 2023 of II Town Police Station, Visakhapatnam registered under Section 328, 284 r/w 34 IPC, Section 22 (C) R/w 8(c) of NDPS Act and Section 18 (C) of D.C.Act.

After hearing both sides and perused the record, since there is well founded accusation against the petitioner, he is not entitled for bail, at this juncture.

In the result, the petition is dismissed.

Pending miscellaneous applications, if any, shall stand closed.
