Miscellaneous Application No. 1326 of 2026

The instant M.A. has been filed by the applicants seeking permission of this Tribunal to join in and pursue O.A. No. 1263 of 2026 together.

For the reasons stated therein, the M.A is allowed.

Original Application

Learned counsel for the applicants submitted that applicants are eligible for promotion to the post of Horticulture Technician Grade-III and sanction was granted by Respondent No. 1 on 01.07.2026 for deputation of applicants to undergo basic one year Basic Horticulture Training Course from SKUAST-K/J, as per terms and conditions of the said order, however, for reasons best known, the Respondent No. 2 is not relieving the applicants to enable them to undergo aforesaid course, which is affecting the service prospects of the applicants for their promotion to the post of Horticulture Technician Grade-III

2.

Learned counsel further submitted that the applicants furnished a representation dated 24.08.2026 and legal notice dated 31.08.2026 to the respondents, however, no action has been taken on the same uptil now.

3.

Learned counsel for the applicants further submitted that the applicants would be satisfied, at this stage, if the O.A. is disposed of with direction to respondents to treat a copy of this O.A. as representation of the applicants and decide the same within a time frame.

4.

Mr. Rajesh Thapa, learned A.A.G. appearing on advance notice prays for sometime to file reply.

5.

Having heard the learned counsels for the parties, I am of the considered view that no useful purpose would be served in keeping this O.A. pending and same can be disposed of in the manner as prayed for by learned counsel for the applicant.

6.

Accordingly, this O.A. is disposed of, at the admission stage itself, without entering into the merits of the case, with a direction to respondents to treat a copy of this O.A. as representation of the applicants and decide the same by passing a reasoned and speaking order. A copy of the order shall be communicated to the applicants. Let the entire exercise be completed within a period of two weeks from the date of receipt of a certified copy of this order.

7.

There shall be no orders so as to costs.
