Grievance in this application is against violation of environmental norms by Raju Tyagi in running Brass and Aluminium Foundry using coal at Mandoli in North East Delhi causing air pollution and damage to public health. The unit was earlier closed on 18.5.2020 in compliance of order of this Tribunal dated 21.04.2022 in O.A. No. 204/2022, Ankur v. Govt. of NCT of Delhi, but the same has been re-opened illegally.

Vide order dated 17.10.2022, the Tribunal sought a factual report from a joint Committee of DPCC and District Magistrate, North East Delhi.

The joint Committee has filed its report dated 27.01.2022 acknowledging that illegal activity was being carried on which has been now closed and environmental compensation levied. It has also been found that even after closure earlier, the activity was re-started illegally but compensation is yet to be recovered.

In view of the above, the DPCC may keep a vigil to prevent violations in future and take necessary measures for recovery of assessed compensation, in accordance with law.

The application is disposed of.
