Judgment
Mr. Anirban Ghorai has sent to this Tribunal by email the present letter petition, which has been treated and registered as O.A. No. 771/2023.
The relevant part of the letter petition enumerating grievances of the applicant is reproduced as follows:-
“I am a residence of Chandapura area of Bengaluru and 200 + years old lake is too much polluted now with untreated sewage inflow and chemical from nearby factories. The entire lake is full of thik black water and stinks like hell.
Local people are dependent on this lake for farming. So they are forced to use this polluted water which is a threat to public health. Last year NGT imposed fine on State Government for not maintaining this lake.. but no real work on ground..pls consider this issue with highest priority and take necessary actions to revive the water body for the benefit of all.”
We have been informed that this Tribunal had taken suo motu cognizance and registered Original Application No. 182/2023(SZ) [EARLIER OA NO. 324 of 2021(PB)] titled as Tribunal on its own motion SUO MOTU based on the basis of news item published in ‘The Indian Express dated 21.11.2021, titled “Lakes of Bengaluru : Industrial Effluents, raw sewage, stinky tale of chandrapura lake”. Vs. Union of India, MOEF & CC, New Delhi and ors. and given interim directions and the matter is now pending before Southern Bench of this Tribunal and is fixed for hearing on 21.03.2024.
In view of the facts and circumstances of the case including the fact that the place of accrual of cause of action lies within jurisdiction of the Southern Zone Bench of this Tribunal at Chennai, we are of the considered view that it will be appropriate if the case is further heard by the Southern Zone Bench of this Tribunal at Chennai.
Accordingly, the Registry is directed to list the matter before the Southern Zone Bench of this Tribunal at Chennai with O.A. No. 182/2023 on the date fixed in that case i.e 21.03.2024 after obtaining orders from Hon’ble the Chairperson for transfer of the case.
