Anand vs State Of Haryana

This application seeks execution of order of this Tribunal dated 20.11.2019 in OA No. 634/2019, Anand vs. State of Haryana. Thereby, the Tribunal dealt with the allegation of dumping of untreated sewage water into pond from drain no. 8 by Public Health Department at Village Ghanipura, District Rohtak, Haryana resulting in killing of fish and loss to the applicant. The Tribunal sought a factual report in the matter and finding that the water quality was adversely affected by discharge of untreated sewage into the pond, the Tribunal directed remedial measures.

In the execution application, it is stated that remedial action has not been taken as directed.

Vide order dated 13.03.2023, the Tribunal issued notice to the State PCB and other concerned officers.

Response has been filed by the State PCB to the effect that Public Health Engineer Department has paid a sum of Rs. 3 lakhs as compensation to the applicant towards claim for loss on account of death of fish.

In view of above, no further order is necessary. However, the pond water be maintained for desired quality to avoid fish death in future.

The application is disposed of.
