Judgment
This is an application to execute order dated 19.08.2021 passed in O.A. No. 205/2021 whereby and where under a direction was issued to the respondent to ensure the compliance of Water (Prevention and Control of Pollution) Act, 1974 and to ensure that there should not be any discharge of untreated water into the waterbodies and to take action in this regard to the compensation to the applicant.
In compliance thereof, Execution Application No. 09/2023 was filed and vide order dated 13.03.2023, the matter was taken up with the direction that District Fisheries Officer, Rohtak has assessed a compensation to the tune of Rs. 3 lakhs payable to the applicant. Respondent Nos. 1 to 4 and the State PCB were directed to submit the compliance report.
Vide order dated 12.05.2023, the report was filed by the State PCB that amount of Rs. 3 lakhs was paid to the applicant for loss on account of death of fish. A direction was issued to the authorities concerned that the quality of water must be maintained in accordance with the parameters laid down by CPCB.
Since the amount of compensation has already been paid, thus, we direct the State PCB to monitor the quality of water and to ensure that it should be as per parameters laid down by CPCB.
With these observations, Execution Application stands disposed of.
