Judgment
This application is filed seeking a direction to respondents No.1 to 4, particularly the respondent No.1 to consider a representation of the petitioner’s father dated 24.08.2026, seeking release of the petitioner/convict prisoner on emergency parole for a period of two months to attend, to take care of and look after petitioner’s father during his urgent and critical brain surgery and to pass such other order or orders in the interest of justice.
The learned counsel for the petitioner submitted that the petitioner is a life convict prisoner and that his father is to undergo brain surgery and his presence is required during the surgery and thereafter to look after him. On being queried as to the date of surgery, it is submitted that if the convict petitioner is granted parole, then they would fix the date of surgery.
The learned Assistant Government Pleader for Home, on written instructions, submitted that the convict prisoner has already been released on parole five times and the same was extended from time to time as per his request. It is further submitted that the convict prisoner is eligible for the next parole only on 12.11.2026. It is also stated that the convict petitioner has not submitted any petition to the Superintendent of Jails for initiating the procedure established by the rules. There is a reference to Rule 974 (2) of the A.P.Prison Rules, for release on parole on emergency leave.
The learned counsel for the petitioner has filed relevant medical records and also the copies of the representations made by petitioner's father to the respondent No.1 as well as the Superintendent of Jails on 24.08.2026, who are the concerned authorities to consider the same. In view of the same both the authorities are directed to take action on those representations under Rule 974(2) and grant parole to the convict petitioner subject to the conditions as they deem fit and proper, for a period of fifteen (15) days for the brain surgery of his father as well as to look after him and appropriate orders shall be passed on or before 02.09.2026. It is made clear that this order is being passed under the exceptional circumstances of the ill-health of the petitioner's father and shall not be treated as a precedent in other cases.
Accordingly, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
