Judgment
The present writ petition is filed seeking for the following reliefs:
"a)Issue a Writ order or direction in the nature of Mandamus to the Respondents to grant Emergency parole of 30 days to the convict, Babu @ Kaddi Babu S/o Late Rajappa (bearing CTP No.15904)
b)Pass such other orders/directions considering the facts and circumstances of the case, together with costs in the interest of justice."
The petitioner has sought for emergency parole for the purpose of completing the obsequies of the paternal grandmother of the convict in question. The convict in question, who is the father of the petitioner, has been sentenced vide order dated 20.01.2026 passed in SC.No.969/2011 by the LXII Additional City Civil and Sessions Judge, Bengaluru1. The highest imprisonment that has been awarded is one for life. It is further placed on record that the petitioner has completed 2 years 5 months and 9 days of custody as an under trial prisoner and thereafter, consequent to the judgment of conviction and sentence, he is serving the same.
The petitioner has produced the photographs as well as the certificate dated 18.09.2026 (Annexure-C to the writ petition) indicating that the paternal grandmother of the convict in question passed away on 17.09.2026.
In view of the aforementioned, release sought for by the petitioner in the present petition merits consideration. Hence, the following:
ORDER
The writ petition is allowed;
The respondents shall release the convict (CTP No. 15904) on Parole for a period of 15 days subject to the petitioner/convict undertaking that the convict in question shall not involve in any unlawful activities and shall not commit any offence during the period of Parole;
Respondent Nos.2 and 3 shall stipulate the conditions as are normally stipulated to ensure the return of the convict to jail;
Violation of any of the parole condition would be viewed strictly;
The Registry to communicate this order to the prison authorities by way of email forthwith;
The present order shall be uploaded online and the concerned authorities shall act on the same upon production of a copy of the uploaded order, which could be verified by scanning the QR code, available in the said order.
