It appears that charge has already been framed by order dated 23.2.2024 and that order is revisable. Initially, in the present case, only cognizance order is challenged and now by way of I.A. the order framing charge is sought to be challenged.
Mr. Pati, the learned counsel appearing for the respondent Union of India relying on the judgment of Hon’ble Supreme Court in the case of Vipin Sahni And Others vs. Central Bureau of Investigation, 2024 SSC OnLine SC 511 submits that in view of paragraph nos. 23 and 25 of the said judgment, the petitioner is required to file revision and only to overcome the limitation, the present writ petition has been filed.
In view of above, the learned counsel for the petitioner, on instruction, seeks permission to withdraw the writ petition with liberty to take recourse under the law.
This writ petition is permitted to be withdrawn and disposed of with the aforesaid liberty.
Withdrawal of the writ petition will not prejudice the case of the petitioner as it has not been decided on merit.
Pending petition, if any, also stands disposed of accordingly.
