Judgment
The Parties are represented through their respective Learned Counsel/CA(s).
Learned Counsel for the Corporate Debtor(Respondent) is present she submitted a Demand Draft bearing no. 507824 of Rs. 2,81,469.00 drawn on the ICICI Bank in favour of the Operational Creditor/Petitioner. It is stated that the corporate debtor has made an offer for settlement of the present matter by making payment of above stated amount as full and final settlement. In response to this, the Counsel for the Petitioner has fairly submitted that the Petitioner is willing to accept the above stated amount by way of demand draft as full and final settlement.
Therefore, the Petitioner Counsel has filed a pursis with such request to withdraw the present IB petition, in view of settlement arrived between the parties. The pursis is taken on record.
In view of this the original demand draft is handed over to the Petitioner Counsel.
Accordingly, CP(IB) 145/2019 is dismissed as withdrawn as settled out of court. No order as to costs.
