Judgment
M.A No.71/2023 – This application has been preferred by “Indian Broadcasting and Digital Foundation”. This application has been preferred for impleadment as a party respondent no.2 in this Broadcasting Appeal mainly for the reason that looking to the pleadings in Broadcasting Appeal and the prayer in the Broadcasting Appeal, this applicant will be directly affected being the Broadcaster’s Association because the rates of channels prescribed by TRAI are to be collected by this applicant.
Having heard the counsels for both the sides and looking to the facts and circumstances of the case, this applicant is a necessary party in Broadcasting Appeal No.1/2023. Hence, this M.A No.71/2023 is hereby allowed.
The applicant, namely “Indian Broadcasting and Digital Foundation” is permitted to be joined as a party respondent no.2. Amended memo of the party shall be supplied by this appellant.
Counsel appearing for this newly joined party seeks time in Broadcasting Appeal No.1/2023 to file reply. Time, as prayed for, is granted till the next date of hearing.
Broadcasting Appeal No.1/2023 is, therefore, adjourned to 25.4.2024.
