Judgment
Heard Mr. Uday Chand Prasad, learned Advocate for the petitioner and learned Advocate for the Bihar School Education Board.
The facts of the case lies within a narrow compass; after having completed secondary education in Nepal and obtaining the school leaving certificate in the year 2016 from Balkrishna MA VI Ram Nagar Bhutaha Sunsari Nepal, the petitioner took admission in Kumar Shashindra Inter College, Birpur, Supaul, Bihar for the intermediate session 2018-20 under the science stream.
It is specifically contended that at the time of Registration Form with the Bihar School Examination Board, the petitioner explicitly declared his nationality as OTHER NEPALI under the column of nationality. However, on account of some inadvertence and clerical error, the respondent Board issued registration certificate by mistakenly mentioning the nationality as Indian. On being found such error, the petitioner approached before the Principal of the College, who verified the record and recommended that his nationality is of Nepal. However, due to clerical error in the certificate, it has wrongly been mentioned as Indian under the column ‘nationality’. In the meanwhile, the petitioner has also passed his intermediate examination.
For necessary correction in the nationality, the petitioner has filed an appropriate application before the Secretary, Bihar School Examination Board after getting proper recommendation by the College in question long back on 20.03.2026. However, till date, necessary correction has not been done. In the aforesaid premise, the petitioner has invoked the jurisdiction of this court seeking appropriate direction.
Learned Advocate for the Board prays for a short adjournment to apprise this court with regard to the present position.
Having considered the nature of the grievance and the materials available on record, this Court instead of keeping the matter pending for counter affidavit, deems it apt and proper to dispose off the present writ petition with a direction to the Secretary, Bihar School Examination Board to look into the grievance of the petitioner, after taking up his representation dated 20.03.2026, the copy of which is marked as Annexure P/5 to the writ petition, and pass appropriate order for correction of the nationality of the petitioner, after due consideration of the official record, preferably within a period of eight weeks from the date of receipt/production of a copy of this order.
The writ petition stands disposed off with the aforesaid direction.
