Judgment

The Delhi Subordinate Services Selection Board (DSSSB) conducted selection for the Post of Primary Teacher, with Code 16/2017 and 1/2018, for various municipal corporations in Delhi. The applicants were selected and appointed to the post of Primary Teachers through order dated 07.09.2019. They were allotted to East Delhi Municipal Corporation. Their grievance is that they ought to have been allotted to SDMC and North DMC, and their posting to East Delhi Municipal Corporation is contrary to law, and the stipulated policy.
We heard Shri Ranjit Sharma, learned counsel for the applicants and Shri R. V. Sinha and Ms. Manisha Tyagi, learned counsel for the respondents.
The applicants were fortunate enough to get selected and appointed as Teachers for the Municipal Corporations of Delhi. There exists a policy, as regards posting to various municipal corporations. Much depends on the choice of candidates on the one hand and their merit on the other hand. Other parameters also need to be taken note of.
Through office order dated 07.09.2019, all the selected candidates were informed that they have to join the duty by 30.11.2019. The task of posting and taking other ministerial steps is entrusted to South Delhi Municipal Corporation. The applicants did not have any grievance at the time of their posting. It is only thereafter that they formed into union or started making representations in groups. Such an approach is totally inappropriate. In case any individual felt that the posting was contrary to any particular provision of the policy that was required to be pointed out before they joined duty, but that was not done. Added to that, posting is the matter of convenience in various corporations.
We do not find any merit in the OA. It is accordingly dismissed. There shall be no order as to costs.
