Judgment
Heard Mr. Vedula Venkataramana, learned Senior Counsel, appearing for M/s. Bharadwaj Associates, learned counsel for the petitioner; Mr. Angothu Nehru, learned Standing Counsel for Central Government, representing Mr. N.Bhujanga Rao, learned Deputy Solicitor General of India, appearing for the respondents; and perused the material on record.
Learned Standing Counsel for Central Government, basing on the written instructions, submitted that the petitioner applied for passport vide file No.HY2064993072325 on 02.05.2025; the application was processed on pre-verification basis. Upon verification, the Police authorities submitted adverse report on 10.07.2025 with remarks - "Requested to send file to applicant native place Pali, Jaunpur, U.P., to verify her nationality". It was observed that the petitioner submitted two birth certificates with different registration numbers i.e. Registration number of one birth certificate is B-2023:9-90347-006950 and registration number of another birth certificate is B-2024:9-90347 dated 16.05.2025. The petitioner has not submitted cancellation of wrong/invalid birth certificate. Learned Standing Counsel submitted that the petitioner cannot hold two birth certificates with conflicting details and thus, the petitioner was issued letter dated 12.07.2026 directing her to cancel the birth certificate with incorrect date of birth and submit proof of its cancellation.
Learned Senior Counsel submitted that the petitioner may be permitted to approach respondent No.2 with all the relevant documents and convince respondent No.2 about the actual date of birth.
In view of the above submissions, this writ petition is disposed of directing respondent No.2 to consider the application of the petitioner dated 16.04.2025 for issuing passport along with the documents that may be furnished by the petitioner, and pass appropriate orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. Until such exercise is done, the impugned letter dated 01.07.2026 shall be kept in abeyance. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in the writ petition, stand closed.
