Judgment
This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
Heard learned counsel for the petitioner as well as learned Additional Government Advocate for the State of Odisha.
The petitioner in this writ petition has challenged the letter dated 20.05.2022 under Annexure-5 issued by the Tahasildar, Rayagada.
It appears that three numbers of cheques were submitted by the petitioner in connection with Sairat Lease Case No.1 of 2021, i.e. Cheque Nos.194963, dated 01.02.2021, 194964, dated 01.02.2021 and 194965, dated 01.02.2021 and the petitioner has given instruction to the Bank to stop payment for which the cheque amount could not be encashed.
Learned counsel for the petitioner seeks some time to file show cause in respect of Annexure-5.
Considering the submissions made by the learned counsel for the respective parties and without going into the merits of the case, if such representation and show cause pursuant to Annexure-5 is filed within a week hence, the same shall be considered giving an opportunity of hearing to the petitioner and necessary decision shall be taken within a period of two weeks thereafter and communicate the result of such exercise to the petitioner.
With the aforesaid observation, this petition is disposed of.
Urgent certified copy of this order be granted on proper application.
