Judgment
Learned counsel for the Petitioner seeks leave to withdraw the writ petition with liberty to approach the Collector, Bhadrak with an appeal against the order passed by the Tahasildar, Bhandaripokhari settling the sand sairat in favour of the intervener in I.A. No.9550 of 2021, Sri Jyoti Prakash Nayak.
If such an appeal is filed not later than 20th December, 2021 accompanied by an application for condonation of delay explaining the delay, the Collector, Bhadrak will consider such application as well as appeal on merit and pass a reasoned order after hearing the present Petitioner and the intervener-Sri Jyoti Prakash Nayak not later than 10th January, 2022.
The interim order passed by this Court on 2nd July, 2021, shall continue till that date. It is made clear that this Court has not expressed any opinion on the merits of the case.
The writ petition is disposed of accordingly.
All the contentions of the parties are left open to be urged before the Appellate Authority.
