G. Rajasuria, J.—This writ petition has been filed to direct the respondents herein to take appropriate action on the representation of the

petitioner dated 10.12.2008 duly received by the second respondent under the Criminal Procedure Code and to give adequate protection to the

Hazrath Thable Alam Badusha Natervali Dargah No. 23/6, Hansa Residency, Collectorate Office Road, Trichy-1.

Heard the learned Counsel for the petitioner and also Mr. D. Sasikumar, learned Government Advocate, who took notice on behalf of the

respondents.

The learned Counsel for the petitioner would echo the cri de coeur of the petitioner to the effect that the petitioner is an Executive Trustee of

Hazrath Thable Alam Badusha, Nathervali Dargha, who lodged a complaint with the second respondent viz., the Inspector of Police, Fort Police

Station, Trichy, highlighting that certain untowards incidents took place at the Kurbani celebration of the Dargah despite that, there is no response.

Hence, this writ petition.

The learned Counsel for the petitioner would also submit that if anything serious happens, over and above, then it would lead to law and order

situation and it warrants the Commissioner of Police to interfere and protect the mosque and maintain peace at the time of worship in the said

Dargah.

Heard the learned Government Advocate.

Hence, in this factual matrix, I would like to pass the following direction:

The petitioner shall appear before the first respondent viz., the Commissioner of Police, Trichy City, Trichy and thereupon the first respondent after

giving due opportunity of being heard to the petitioner, shall call for report from the second respondent viz., the Inspector of Police, Fort Police

Station, Trichy as per the Criminal Procedure Code. The first respondent shall see to it that adequate protection is given and there shall be no undo

incidents takes place in the said Dargah.

With the above said direction, this writ petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
